Two Significant Employment Law Developments Just Happened!

The Federal Department of Labor increases the salary threshold for exempt employees

The new rule will become effective on 7/1/24 and will increase the salary threshold from $35,568 to $43,888. It will increase again on 1/1/25 to $58,656 and thereafter will increase automatically every 3 years.  Whether you’re just in California or have employees in other states, this is a perfect opportunity to revisit the rules and even perform an internal audit of your current exempt classifications. The Federal Trade Commission seeks to ban noncompete agreements

The new rule would ban noncompete agreements nationwide (with very few exemptions) and make existing ones unenforceable. It would also obligate employers to inform current or former workers that their existing noncompetes cannot be enforced. We have gotten used to noncompetes being largely illegal in California but there would be new responsibilities for California employers if the federal rule becomes law.
